First Mortgage, Inc. (FMI) works with a variety of different entities such as Title Companies, Attorney Firms, and individuals.
An account can be established with FMI, with or without, real property securing the loan. If you have real property which is secured by a Deed of Trust, we recommend that a title company is used for the correct documents to be prepared. The Title company will also prepare all the FMI forms necessary to establish an account.
If individuals, or an attorney firm, set up an account please verify the appropriate documents to be placed with FMI. There is a form checklist available on our FORMS page. FMI is not a lienholder in any transaction. Therefore, if a Deed of Trust is recorded, FMI will require a request to reconvey that deed of trust. FMI cannot be listed as a Trustee of record or can we execute any lien release/reconveyance unless specifically stated in the Deed of Trust Special Conditions and Covenants.
If the parties do not intend to record any documents that places a lien on the property, that will need to be noted in the Special Instructions of any Contract Setup. The language “unsecured” note can be used which will alert the staff that releasing real property is not a part of the Contract.
